Terms of use
Last updated 29 October 2026. Please read these. For organizers, they include binding individual arbitration and a waiver of class actions, unless you opt out (see Disputes).
Who we are
vision lab is run by The Vision Lab, LLC, a New York limited liability company, 12 Lexington Ave, Greenwich, CT 06830 (“we”). Contact us through the contact form.
Agreeing to these terms
You accept these terms by ticking the box when you create an account, or when we ask you to accept an updated version. Our privacy page explains how we handle personal information. If you use the service for an organization, you confirm you have authority to accept these terms for it. In that case “you” includes the organization, which we call the “Customer”. You must be 18 or older. If you do not agree, do not use the service.
These terms are mainly for organizers: people who create an account to run projects, and the organizations they act for. If you only take part in a project by voting, adding ideas or commenting, you do not accept these terms by taking part, and the arbitration, class action waiver, jury waiver, one-year deadline and indemnity in them do not apply to you. Please still follow “Using it well”.
What this is
vision lab is an experimental product that is still being built. It may change, pause or stop at any time, and features may be added or removed without notice. Don’t rely on it as your only copy of anything. Download the results you need to keep. The beta terms also apply while we are in beta.
Price
Pricing. There is no subscription and no card to enter while we are in beta.
Talk to us. If you would like to use vision lab for larger or ongoing work, contact us to discuss options. Nothing is owed unless you and we agree it in a signed agreement or purchase order that we have accepted in writing. We never charge automatically. Terms printed on or linked from a purchase order do not apply unless we sign them.
Larger organizations. We are happy to review your organization’s terms. If you and we sign an agreement, order form or data processing agreement, that signed document controls where it conflicts with these terms. Otherwise these terms apply.
Using it well
- Don’t post anything unlawful, defamatory, hateful, harassing or threatening, or that exposes someone’s private information.
- Don’t post material you have no right to share, including your employer’s confidential information.
- Don’t try to game votes, such as using many devices or networks to push an idea. Limits are in place and may block you.
- Don’t break the service, scrape it, probe it for weaknesses, look at other people’s projects, or use it to send spam.
- Don’t try to find out who wrote an idea or how anyone voted, except as the service openly shows you.
We may remove content, limit access or suspend accounts if we reasonably believe these rules are broken, or it is needed to protect people, the service or our legal position. For free use, we may act with or without notice. If the Customer has a signed agreement with us, we will give notice and a reasonable chance to fix the problem first, unless we must act at once to prevent harm, stop a security threat or comply with law.
Organizers
If you run a project, you are responsible for it and for how you invite people to it. You confirm that you have the right to invite each person and to contact them at the address you give us, that you will tell participants what the project is for and who will see the results, that you will follow the laws that apply to you (including privacy, anti-spam, employment and labor laws, and any duty to inform or consult employee representatives), and that you will not put in sensitive personal information such as health, financial or government ID details, or information about anyone’s race, religion, sexual orientation, union membership or other sensitive characteristics. You will not invite anyone under 18. You will not try to identify participants or link votes or ideas to individuals, and you will use groups large enough to protect anonymity; we recommend at least 25 people. We send invitations and reminders on your behalf, and you are the sender. For personal information in your projects, we process it on your behalf as described on the privacy page.
AI-drafted content
Organizers who use AI drafting are responsible for reviewing and editing the draft before they share it. AI-generated text can contain errors or leave things out, and the organizer is responsible for anything they send to reviewers or decision-makers. Do not use AI drafting for projects where ideas are likely to contain confidential or personal information, unless your organization permits it.
Not for employment decisions
Results show what a group thinks about ideas. They are not an assessment of any person, and vision lab is not designed, tested or validated to evaluate people. Do not use the service or its results (including rankings, reviewer scores, decisions or who suggested an idea) to decide, or to substantially assist in deciding, hiring, firing, promotion, pay, discipline or any other decision about an individual’s employment, or to identify, monitor or retaliate against anyone who took part. If you do, you are solely responsible for complying with any law that applies to that use, including laws on automated employment decision tools, and the indemnity below applies.
Your content
We don’t own the ideas, comments or votes added to your projects. Who owns them as between participants and the Customer is a matter for them. You can view and download your project’s ideas at any time. By adding content, or inviting others to add it, you give us a worldwide, non-exclusive license to store, show, copy, process and analyse it to run, secure, support and improve the service and to create anonymized information from it as described below, and you confirm you have the right to give this license. Organizers also give it on behalf of their organization. We will not use your content to train AI models that are made available to others unless you agree first. You are responsible for what you post. Ideas reported by several people are hidden automatically.
Anonymized information
We may analyse content and activity, including idea text, to produce insights and statistics that do not identify any person or organization, and we may keep and use them after a project is deleted. To do this we combine results so that no group smaller than five is shown, remove names, email addresses, organization names and other details that could identify someone, do not quote idea text unless it has been reviewed to remove such details, and keep insights separate from your account. We will not try to re-identify anyone from anonymized information, and we require anyone we share it with to agree to the same. We may use service providers, listed on the privacy page, to help, under written terms that limit their use of your content.
Reporting content and copyright
To report content that breaks these terms, use the contact form with the topic “Report”. Tell us where the content is, what is wrong and how to reach you. Copyright notices under the Digital Millennium Copyright Act go to our designated agent: Trevor Madigan, The Vision Lab, LLC, 12 Lexington Ave, Greenwich, CT 06830, trevor@thevisionlab.com. We may remove content and respond promptly to valid notices and counter-notices. We end the accounts of repeat infringers where appropriate. We may keep and share records when the law requires it or to protect people or the service.
Our property
The service, software, name, logo and design belong to us and our licensors. Use the service as offered. Don’t copy it, resell it, reverse engineer it, or build a competing service from it. We may use any feedback you give us without owing you anything.
No guarantees
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
We don’t promise it will be secure, accurate, error-free or uninterrupted, or that results are complete or correct. Rankings, themes and analytics are a guide to what a group thinks, not advice of any kind, and decisions made using them are yours alone.
Limit of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE AND OUR OWNERS, OFFICERS, EMPLOYEES AND PROVIDERS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST GOODWILL, BUSINESS INTERRUPTION, OR DECISIONS MADE USING THE SERVICE, EVEN IF TOLD THEY MIGHT HAPPEN. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF US$100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
These limits do not apply to liability that cannot be limited by law, such as for fraud, gross negligence or willful misconduct.
Indemnity
The Customer (or, if there is no Customer, the organizer) will defend us against any claim brought by a third party, and pay any resulting damages, fines, settlements and reasonable lawyers’ fees, to the extent the claim arises from (a) content in the Customer’s projects, (b) the Customer’s invitations or contact lists, (c) use of the service or its results in breach of “Not for employment decisions”, or (d) the Customer’s breach of these terms or the law. This does not cover claims to the extent caused by our breach of these terms or our own misconduct. We will tell you promptly about the claim, let you control the defense, and cooperate at your cost. You will not settle a claim in a way that admits fault for us or binds us without our written consent, which we will not unreasonably withhold.
Disputes
These terms are governed by New York law and the Federal Arbitration Act. Before filing a claim, send us a written notice through the contact form describing the problem, and give us 30 days to resolve it. We will do the same for you, using your account email.
The rest of this section applies to organizers and the organizations they act for. If it is not resolved, any dispute will be settled by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in New York, not in court. The arbitrator decides any question about whether a dispute must be arbitrated. If 25 or more similar claims are filed by or with the help of the same lawyers or group, they will be administered in batches as the AAA’s mass arbitration procedures provide. Either side may bring an individual claim in small-claims court, and either side may go to court to protect intellectual property or stop misuse of the service. Claims may be brought only on an individual basis, not as a plaintiff or member of a class or group. Claims must be started within one year after they arise. To the extent the law allows, each side waives a jury trial in any case that goes to court.
Organizers may opt out of arbitration within 30 days of creating an account by using the contact form with the topic “Opt out”. If any part of this section is found unenforceable, the dispute will go to the state and federal courts in New York County, New York, and you and we consent to their jurisdiction. This section does not apply to disputes that arose before 29 October 2026.
If you only take part in a project by voting, adding ideas or commenting, any dispute between you and us will be decided in the state or federal courts in New York County, New York, or in a small-claims court where you live. Nothing in these terms requires you to arbitrate or waives your right to take part in a class action.
Ending
You may stop using the service and delete your projects at any time. We may suspend or end access as described under “Using it well”, and during the beta we may also pause or end free access, as the beta terms explain. Sections that by their nature should continue (content, anonymized information, our property, no guarantees, limit of liability, indemnity and disputes) continue after that.
General
Neither side is responsible for failures outside its reasonable control. If part of these terms is unenforceable, the rest stays in force. We may transfer these terms in a sale or reorganization. These terms, the privacy page, any beta terms and any signed agreement are the whole agreement, and a signed agreement controls if they conflict. We may change these terms by updating the date above, and we will email organizers at least 30 days before a material change takes effect. Using the service after a change takes effect means you accept it. Changes to “Disputes” do not apply to disputes that arose before the change.
Accessibility
We aim to make the service usable by everyone, and we are working toward the Web Content Accessibility Guidelines (WCAG) 2.2, Level AA. If you have trouble with any part, tell us through the contact form and we will work with you on an alternative.
